Westchester County, NY to ‘Ban the Box’ in March 2019

Special Announcement to all Westchester County, NY employers:

Effective March 03, 2019, the County of Westchester, NY will impose an ordinance, Local Law #10913, that restricts employers in the county from asking about and using criminal record information.

Under the law, the following restrictions, will apply:

1. An employer may not make any inquiry regarding, or to require any person to disclose or reveal, any criminal conviction in an application for employment.

2. Before taking any adverse action based on such inquiry, the employer shall perform an analysis of the applicants criminal record and other factors under Article 23-A of the New York State Correction Law.

 

This law will require a review of the hiring process in place and may require changes to that process. Justifacts recommends that you consult with your legal department to determine what changes, if any, need to be made to your hiring process in order to comply with this law.
