Am I required to use E-Verify?
Currently, E-Verify is a voluntary program for most employers. E-Verify is mandatory in some instances including, but not limited to:
- Employers with federal contracts that contain the FAR E-Verify clause
- Arizona, Georgia and Mississippi employers
- Public contractors in Colorado, Georgia, Missouri, Nebraska, Oklahoma, Rhode Island and Utah
- State agencies in Colorado, Georgia, Idaho, Minnesota, Missouri, Nebraska, North Carolina, Oklahoma, Rhode Island and Utah
E-Verify is available in all 50 states, the District of Columbia, Puerto Rico, Guam, the U.S. Virgin Islands, and Commonwealth of Northern Mariana Islands, is currently the best means available to electronically confirm employment eligibility.
Can I use E-Verify to pre-screen applicants?
No, E-Verify cannot be used as a pre-screening tool. The earliest you are able to initiate a query is after an offer of employment has been made and the I-9 form has been completed.
