Electronic I-9 System

Justifacts’ partnership with formi9 Compliance ensures that our clients have the most efficient and up-to-date process for creating, managing, and storing electronic I-9 forms. It includes a variety of aids, such as alerts and notices for expiring documents and seamless integration with the E-Verify process, for minimizing errors and turnaround time. The electronic I-9 system reduces paperwork for Human Resources, eliminates the threat of I-9 theft, and reduces the misinterpretation of data by handwriting recognition software. Alerts and notifications are provided for all pending and complete I-9′s, as well as for those that no longer need storage based on USCIS requirements.


E-Verify is an Internet-based system operated by the Verification Division of U.S. Citizenship and Immigration Services (USCIS), which is part of the Department of Homeland Security (DHS), in conjunction with the Social Security Administration (SSA).

Justifacts is a registered “Employer Agent” authorized to process all E-Verify requests for an employer, which we offer as a stand-alone service or in combination with our electronic I-9 process. Employers participating in E-Verify are required to have information from the employee’s Form I-9 submitted to E-Verify, which then routes the information to the appropriate data sources to determine employment eligibility.

Justifacts has automated this process by designing a direct integration with the E-Verify system, which helps streamline the process of submitting information to the E-Verify system. Additionally, for those clients using our partnership with formi9 Compliance, the electronic I-9 is seamlessly transferred to the E-Verify system. This process improves both speed and accuracy, which lessens the likelihood of receiving a Tentative Non-Confirmation (TNC) result from E-Verify.

When used in conjunction with each other, the electronic I-9 system and E-Verify agent allows access to an affordable, fast, and accurate method for verifying the work eligibility of all newly hired employees.

Am I required to use E-Verify?

Currently, E-Verify is a voluntary program for most employers. E-Verify is mandatory in some instances including, but not limited to:

  • Employers with federal contracts that contain the FAR E-Verify clause
  • Arizona, Georgia and Mississippi employers
  • Public contractors in Colorado, Georgia, Missouri, Nebraska, Oklahoma, Rhode Island and Utah
  • State agencies in Colorado, Georgia, Idaho, Minnesota, Missouri, Nebraska, North Carolina, Oklahoma, Rhode Island and Utah

E-Verify is available in all 50 states, the District of Columbia, Puerto Rico, Guam, the U.S. Virgin Islands, and Commonwealth of Northern Mariana Islands, is currently the best means available to electronically confirm employment eligibility.

Can I use E-Verify to pre-screen applicants?

No, E-Verify cannot be used as a pre-screening tool. The earliest you are able to initiate a query is after an offer of employment has been made and the I-9 form has been completed.
