Justifacts also offers a paperless, electronic Chain of Custody (COC) form and an online scheduling system that is available for users to schedule tests, choose collection sites and set customized parameters that determine cutoff times, as well as immediate email or text the COC to the applicant.

The Department of Transportation is rolling out a secure, online database that will give employers and other authorized users real-time information about commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders’ drug and alcohol program violations. The FMCSA, or Federal Motor Carrier Safety Administration, Clearinghouse will contain records of violations of drug and alcohol prohibitions in 49 CFR Part 382, Subpart B, including positive drug or alcohol test results and test refusals. When a driver completes the return-to-duty (RTD) process and follow-up testing plan, this information will also be recorded in the Clearinghouse. Beginning January 6, 2020, Justifacts can assist employers in completing this required search for all applicants and existing employees. The FMSCA Clearinghouse includes:

  • Reports of drug and alcohol violations. This will include alcohol test results with a concentration of .04 or greater, refusals to take an alcohol or drug test, as well as actual knowledge of a violation.
  • Negative return-to-duty (RTD) test results and the successful completion of a driver’s follow-up testing plan.

Effective January 6, 2020, employers are required to query the Clearinghouse on all prospective covered employees and all current covered employees at least annually. All queries require driver consent.

Please note, until January 6, 2023, employers must conduct both electronic queries in the Clearinghouse and manual, offline inquiries to previous employers for pre-employment driver investigations.

All tests are performed to SAMSHA standards and include a review by a Medical Review Officer. We offer an electronic Chain of Custody (COC) form and an online system for scheduling tests, choosing collection sites, customizing cutoff times, and immediately emailing/texting the COC to the applicant. Once test results are completed, they are seamlessly incorporated into the background report, keeping all of the information pertaining to your candidate in one easy-to-read report.

Justifacts’ services are comprised of all types of testing (e.g. pre-employment, random, DOT, etc.) and include the standard 5-, 9-, and 10-panel drug tests. While the most common form of testing is a urine sample collected at a collection site, Justifacts also offers hair tests and lab-based oral tests, for which the specimen is collected onsite and then sent to the lab for testing.
