No Cost Secure Email Option Available for Adverse Action Letters

Dear Justifacts Client:

Justifacts is excited to announce the availability of sending pre-adverse and adverse action letters via secure email. Advantages from using this new option include:

  • Lower costs
  • Faster delivery
  • Increased security

As you are aware, the Fair Credit Reporting Act (FCRA) requires providing the consumer with both a pre-adverse and adverse action letter any time a report is used in a hiring decision. The FCRA has no specific requirement to provide these letters via the mail, so the use of email is an acceptable alternative.

Due to the sensitive nature of the information in the reports, Justifacts has created a system that sends these letters via secure email. When activated, two emails are automatically triggered. The first email is a brief notice that a secure email is being sent – this lets consumers know to expect the secure email and not treat it like spam. The second email is sent to the consumer with the subject “You have a new encrypted message from Justifacts”.  The consumer can access the adverse notice via a link in the email. After creating a password to log in to the secure email system, the consumer can view a copy of their report, the summary of rights and any appropriate state-specific notices.

There is no cost to use this feature, but it is only available to clients that use our applicant portal system.
