Philadelphia to Limit Employers’ Ability to Test for Marijuana

Special Announcement to all Philadelphia employers :

 On 04/28/2021, the Mayor of Philadelphia signed a law, Bill# 200625, that limits an employers ability to test for marijuana. The law will be effective on 01/01/2022.

The law makes the following an unlawful practice:

It shall be an unlawful employment practice for an employer, labor organization, employment agency or agent thereof to require a prospective employee to submit to testing for the presence of marijuana in such prospective employee’s system as a condition of employment.

There are several exceptions enumerated in the law.

This law will require a review of the hiring process in place and may require changes to that process.

Justifacts recommends that you consult with your legal department to determine what changes, if any, need to be made to your hiring process in order to comply with this law.
